0. 23-acre cleared lot in Rainbow Park (west Marion). Zoned R-1 (site-built single-family homes only). Not in a flood zone. Close to nature, shopping, trails, parks, rivers, zip-lining, and equestrian facilities. Power lines are present directly in front of the lot along the road. One potentially occupied, legally protected gopher tortoise burrow was identified in the south-central portion of the property. Given the parcel size and burrow location, avoidance of the required 25' buffer is unlikely. If avoidance is not feasible, the tortoise must be permitted and relocated prior to any clearing or ground-disturbing activities. On-site relocation may be possible, as suitable habitat exists in the southeastern portion of the property; however, a minimum 750 sq ft preserve area with at least half beyond 25' from construction/clearing must be maintained per FWC requirements. Estimated costs are $2, 200 for on-site relocation or $8, 200 for off-site relocation (which includes a $6, 000/tortoise recipient site fee). Note that even if the burrow appears inactive, it remains legally protected under Florida law, and a permit is required before any development activity occurs within 25' of the burrow.
